Terms and Conditions for Nannyke Platform

Service Provider Verification

1. Verification Process

All service providers (nannies) on the platform must undergo a verification process to confirm their identity, qualifications, and ability to provide the services they advertise. By using the platform, service providers agree to provide accurate and truthful information. Falsification of information may result in immediate removal from the platform and legal action.

Service Scope and Quality

1. Qualified Services

Service providers must only offer services they are qualified and capable of performing. Any misrepresentation of skills, experience, or qualifications may lead to termination of their account and liability for damages incurred by the service buyer.

Commission Fee

1. Fee Structure

The platform charges a one-time commission fee of 20% of the monthly service charge for each successful match, for both the service provider and buyer. This fee payment made by the service buyer upfront in full, who then recovers their 20% made on behalf of the service provider off of their first monthly pay and revert back to full payment on subsequent months.

Conduct in Service Locations

1. Workplace Guidelines

Service providers must adhere to the guidelines and rules set by the service buyer (homeowner) while working in their premises. Failure to comply with these guidelines may result in termination of the engagement and removal from the platform.

Liability for Actions

1. Service Provider Responsibility

Service providers are fully liable for their actions, conduct, and performance while engaged in their work. The platform is not responsible for any damages, injuries, or losses caused by the service provider during the course of their work.

Platform Liability

1. Limited Liability

The platform's liability is limited to facilitating the connection between service providers and service buyers. Once the connection fee is received and the match is confirmed, the platform's liability ends. Any disputes or issues arising after the connection must be resolved directly between the service provider and the service buyer.

Non-Refundable Payments

1. Payment Terms

All payments made through the platform, including connection fees are non-refundable. Service buyers and providers acknowledge that once payment is processed, it cannot be reversed.

Minimum Service Charges

1. Fee Guidelines

Service buyers (employer) must adhere to the minimum fee guidelines set by the relevant workers' union or regulatory body. If a service provider agrees to charge below the stipulated minimum, they assume full liability for any consequences arising from this decision, and the platform bears no responsibility.

Termination of Engagement

1. Account Suspension

The platform reserves the right to terminate or suspend the accounts of service providers or service buyers who violate these terms and conditions, engage in fraudulent activities, or fail to meet the platform's standards of conduct.

Dispute Resolution and Governing Law

1. Legal Framework

Any disputes arising from the use of the platform shall be resolved through mediation or arbitration as agreed by both parties. These terms and conditions are governed by the laws of Kenya, and all parties agree to submit to the exclusive jurisdiction of the courts in this region.

Privacy and Data Protection

1. Data Handling

The platform will handle all personal data in accordance with applicable data protection laws. Users must consent to the collection, storage, and use of their data as outlined in the platform's Privacy Policy.

Amendments to Terms

1. Terms Updates

The platform reserves the right to update or modify these terms and conditions at any time. Users will be notified of any changes, and continued use of the platform constitutes acceptance of the revised terms.
